The March 2016 Update to the Risk Management Program Rule proposed by the U.S. EPA contains a number of provisions for the requirement of third-party audits. Although benefits are perceived by the U.S. EPA and some potential benefits may also exist for the owner/operator, a number of potential pitfalls exist. The primary focus of this paper will be to provide planning and observational guidance to the owner/operator and to the regulator to ensure that a third-party audit is effective and fair. Key topics will include:
- Brief overview of third-party audit requirements and regulatory trigger points
- Potential benefits to the regulator and owner/operator
- Potential cautions and pitfalls
- Characteristics of an effective and fair audit team
- Platform for achieving balanced results
- Mechanisms for disputing or putting findings into perspective (useful for both the owner/operator and the regulator)
